📉 STR Loophole Window - Time is almost up for 2025 Participation
Most investors still don’t realize that short-term rentals (STRs) can qualify for accelerated depreciation without being treated as passive income. It’s one of the most powerful (and legal) ways to reduce your 2025 tax bill — but timing and execution matter.
The “STR Loophole” allows investors to claim bonus depreciation and major write-offs in the first year if their property qualifies as an active short-term rental business, not a passive investment. To do that, investors must materially participate — typically through managing guests, pricing, cleaning, and operations.
The key steps:
Identify a qualifying property (under 7-day average stays, zoned & legal permit or licensing, in a strong tourism or vacation market).
Close and place it in service before year-end to capture 2025 depreciation.
Document active participation to meet IRS standards and defend your position.
With weeks to spare before the tax year closes, investors still have time to acquire, furnish, and launch a compliant STR — especially if they act fast in high-demand markets like the Oregon Coast, Scottsdale, or Florida Panhandle.
❌ Purchasing a vacation rental in 2025, 2026 or 2027 and want to utilize an LLC? While DSCR and NON-QM (alternative income and asset verification) loans often permit closing in an LLC or Trust, most conventional lenders (the best rates and terms) DO NOT. In fact - although not generally enforced, lenders can actually call most conventional mortgage notes if ownership is transferred. On a positive, there are national lenders (LIKE Loan Factory!) that allow transfer or deed or ownership post closing. Our advice is to be as transparent as possible with your licensed mortgage professional. Read more on what to look out for and expect to execute.
